Another Cancellation Letter

I was surprised to find out that your company is refusing to comply with the laws of Mexico by failing to provide us with the "full and unconditional refund" of our deposit. I have discovered that waiver of that right is not permitted and that any suggestion that a waiver of this right can be imposed or agreed to constitutes fraud. In light of that fact, I have lodged a complaint with the Mexican Federal Government Agency "PROFECO" to investigate this situation. You should be hearing from them shortly. Both you and your Accounts Manager, Mr. XXXXl made such claims and so I have named you both in my complaint. You may be interested to know that I recorded my telephone conversation with you and am able to verify my concerns. Also of interest is the fact that alcohol was used during the sales presentation; that fact is documented in the "reasons why I joined today" document.

 

In addition to lodging a complaint with PROFECO, I have lodged a complaint with RCI and with XXXXX Hotels. Your property will be added to those of concern on WEBsites devoted to concerns about timeshare practices. I have been in contact with one individual who has researched this type of practice who was involved with the successful prosecution of sales persons under similar circumstances.

 

I have also filed a dispute with VISA and they will be contacting you to determine why a credit was not issued immediately when you received my letter.

 

I feel it is important for me to inform other potential victims of these practices and so I will be sending information and articles to other WEBsites and travel publications on a regular basis.

 

Mr. XXXX's suggestion that some of my deposit should be held back because "commissions have been paid" rings hollow since I submitted my letter of rescission within 4 days of signing the contract. Any expenses by your company would certainly have been incurred after the fact.

 

I regret that this issue has been  escalated to this level. I recall when I asked why your contract did not provide information about a "cooling off" period, you replied that you would never hold anyone to a purchase they were unhappy with. I am really only interested in the refund due to me as prescribed by law. I'm certain our sale is not the first to be lost, and I'm certain it won't be the last.
